General Service Liability Waiver
& Terms of Service

This waiver applies to all repairs or services performed by North Shore Bikes, LLC DBA Shorewood Bikes (“the shop”) on bicycles, electric cycles, strollers, or other personal mobility products. By submitting payment or accepting the completed service, I acknowledge and agree to the following terms:

Ownership Certification

I certify that I am the legal owner of the equipment presented for service, or that I am authorized to request service on behalf of the owner.

Manufacturer Warranty Disclaimer

I understand that service performed by the shop may not be covered under any manufacturer warranty and may, in some cases, void an existing manufacturer warranty. I acknowledge that the shop does not represent or administer manufacturer warranties.

Assumption of Risk – Service

I accept full responsibility for the known and unknown risks of operating a cycle, including risk of serious injury, death, or property damage, and responsibility of operating the cycle within all applicable law. This includes risks arising from mechanical failure, operator error, road conditions, and product defects.

I hereby release, waive, and discharge North Shore Bikes, LLC DBA Shorewood Bikes, its owners, employees, agents, members, managers, and affiliates from all claims related to:

  • Injuries or damages arising after the service is complete
  • Equipment failure due to pre-existing conditions or unrelated components
  • Consequences of using equipment not intended or deemed legal for public road use

This release extends to my heirs, legal representatives, assigns, and any third party involved.

NO WARRANTY FROM THE SHOP

THE SHOP DISCLAIMS ANY RESPONSIBILITY FOR ANY DAMAGE, INJURY, HARM, COST, EXPENSE, OR LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OR MISUSE OF THE CYCLE. THE CYCLE IS PROVIDED ON AN AS-IS BASIS AND WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, NON-INFRINGEMENT, OR QUALITY.

RELEASE OF LIABILITY

THE SHOP WILL NOT BE LIABLE TO YOU UNDER ANY LEGAL THEORY, WHETHER IN WARRANTY, CONTRACT, STRICT LIABILITY, TORT, OR NEGLIGENCE, FOR ANY DAMAGES, CLAIMS, INJURIES, JUDGMENTS, COSTS, OR LIABILITIES OF ANY KIND ARISING OUT OF OR RELATED TO YOUR USE OR MISUSE OF THE CYCLE, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, DAMAGE TO PROPERTY, LOSS OF BUSINESS, LOSS OF INCOME, SPECIAL DAMAGES, INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES, PUNITIVE DAMAGES, OR EXEMPLARY DAMAGES, WHETHER FORESEEABLE OR UNFORESEEABLE. IN NO EVENT WILL THE SHOP’S LIABILITY EXCEED THE VALUE OF THE CYCLE(S) SOLD.

I release and discharge the shop and its owners, employees, agents, members, managers, and affiliates from any claims, damages, injuries, or losses related to the use, operation, resale, or transport of the electric cycle.

Indemnification and Legal Fees

I agree to indemnify and hold harmless the shop from any third-party claims or legal actions related to the cycle. I further agree to reimburse all reasonable legal fees, court costs, and out-of-pocket expenses incurred by the shop if it is named in any claim or lawsuit.

Legal Age & Competency

I confirm that I am at least 18 years old and legally competent to enter into this agreement.

Right to Refuse Service

I acknowledge that the shop reserves the right to refuse service on any equipment deemed unsafe, unrepairable, or improperly modified.

Condition Upon Return

I acknowledge that if I did not receive my equipment in the condition described in the estimate or service record, I must notify the shop within 48 hours by emailing hello@shorewoodbikes.com and include supporting photos. I understand the shop is not liable for cycles left outside before or after service, including any loss, theft, or damage to the cycle in connection as a result of being dropped off at the customer’s desired location.

Severability

If any part of this waiver is found to be invalid or unenforceable, the remaining terms shall remain in full force and effect.

Scope of Coverage & Entire Agreement – Service

This waiver applies to the specific service estimate and all related work performed under that estimate, including follow-up adjustments, inspections, or parts installations.

I agree that this is the entire agreement between myself and the shop regarding the scope. This waiver may not be amended or modified except in a written agreement signed by both myself and the shop.

Governing Law

By signing, I acknowledge that I have read and fully understand this waiver and agree to be legally bound by its terms. This agreement shall be governed by the laws of the State of Wisconsin. Any dispute shall be resolved in a court located in Milwaukee County, Wisconsin.

By Booking an appointment with the shop, I consent to receive SMS messages related to my service including but not limited to invoicing and appointments, including confirmations, reminders, and updates.
